case against Jas Smith at
Nelson Creek, he has no pro
perty to make the money
out of.. the other case was la
id over ten days fir time to
anser. in that time the court
adjournd I was some unwe
ll with chills, overton came
over. wife & I made a deed to
the ranch & took up our note
& mortgage, we made every
effort in our power to wind
up wife in the mien time
closd out at the tavern &
we sold off most of our loos
plunder we got a horse & spr
ing waggon to leave the vally
in whitch we done, but not
until we had made some
arrangements to get the Ranch
back, wife paid 300$ & left
150$ for John to pay whitch he
did soon after we left.

there had been a big fall of
snow for the season, but we
got out before any moore fell &
in November we were three
days getting down to Jacks
soon after. I went up to Bou
rnes to get money he owed, a few
days after he dent me 360$ in
two parcels & I sod the horse &
wagon to Jack for 250$ I then
sent Overton 550$ November
22nd. I put in my time
helping Jack. wrote 3 letters
to John to come down & John
wrote one to his ma that he
would wait until I came up
we get it about 20 Jan 1859
so on Sunday morning at 6
I put for the mountains & that
evening I suppose John arrivd
at Jacks, my passage up to
New York house was 6$ then I
